ESTATE LITIGATION & DISPUTE RESOLUTION

We approach estate litigation with technical expertise and a commitment to strategy, integrity, and results. Our clients trust us to guide them through complex disputes with care and sound judgment, knowing we will advocate for their best interests at every stage.

Our experience in estate litigation is extensive, covering a wide range of disputes. We have extensive experience in each of the following areas of litigation and dispute resolution:

  • Will Challenges – Representing clients in disputes about the validity of a will, including allegations of undue influence, fraud, or lack of capacity.
  • Dependant Support Claims – Advocating for individuals who were financially dependent on the deceased and have been unfairly left out of the will or for whom the will makes inadequate provision.
  • Breach of Fiduciary Duty – Holding executors, trustees, or attorneys accountable when they fail to act in the best interests of beneficiaries or misuse their authority.
  • Equitable Claims – Addressing cases where the law alone does not provide a fair outcome. We help recover funds or assets in situations of unjust enrichment, broken promises, or unfair property arrangements, including claims in constructive trust and proprietary estoppel.
  • Powers of Attorney Disputes – Resolving conflicts over financial or personal care decisions made under a power of attorney, including cases of misuse or breach of fiduciary duty.
  • Adult Guardianship & Representation – Advocating for families and vulnerable individuals who need legal protection in decisions about their care, finances, and well-being.
  • Estate Trustee and Executor Disputes – Handling conflicts over how an estate is administered, including concerns about an executor’s actions, removal, or compensation, as well as disputes between co-executors.
  • Accounting & Financial Disputes – Ensuring executors, attorneys, and trustees provide proper financial disclosure and are held accountable for any mismanagement.
  • Joint Asset & Beneficiary Disputes – Clarifying ownership and entitlements when joint accounts, joint real estate, or beneficiary designations are contested.
  • Intergenerational Property Disputes – Addressing conflicts that arise when family property has been transferred, promised, or shared under informal or unclear arrangements.

Many of the most significant estate disputes we have handled – including those involving family businesses, trusts, and high-value estate – have been successfully resolved through negotiation. However, when litigation is necessary, we advocate forcefully in court.
